Résumé
En droit français des successions domine le principe de la continuation de la personne du défunt : les héritiers remplacent le défunt, se substituent à lui, même s'ils ne sont pas personnellement fautifs.
Les héritiers peuvent toujours renoncer à une succession en présence d'un passif supérieur à un actif, mais il ne paraît pas non plus souhaitable d'agir de la sorte au motif que des actions en responsabilité risquent d'être intentées. C'est oublier notamment le droit des assurances...
Abstract
In French law of succession the principle of continuation of the person of the deceased is a dominant factor: heirs replace deceased persons, they become substitutes for them, even if they have not been personally responsible.
The heirs can always refuse the right of succession when debts are greater than assets, but this procedure isn't often an acceptable solution because of the high risk of it's inciting a law suit. It would also abandon the right to collect insurance benefits. If dentists, treatment of patients failed to meet usual and customary standards of practice, are their heirs, after their decease, required to pay damages to the aggrieved patients? These are some of the elements that must be evaluated in formulating an answer to that redoubtable question.
